Yacht Master Class — Waiver, Release of Liability, Assumption of Risk & Indemnity

Important: Please read carefully before signing. This is a legal document. By signing it, you accept the risks of sailing and boating activities and give up certain legal rights, including the right to sue in some circumstances. If you have questions, please ask before signing.

This waiver applies to all on-water sailing instruction, coaching, courses, training, and related activities provided by Patrik Lindr operating as Yacht Master Class (“Yacht Master Class”, “YMC”, “we”, “us”, or “our”).

Participation in on-water training is conditional on signing this waiver before boarding or before training begins. If I do not sign this waiver, I understand that I will not be able to participate in the on-water activity.

My booking is also subject to the Yacht Master Class Terms & Conditions, which cover booking, payment, cancellation, conduct, certification, and other course arrangements.

1. Activities covered

This waiver applies to all activities connected with my participation in YMC training, including boarding, disembarking, moving around vessels, sailing, motoring, docking, anchoring, manoeuvring, sail handling, ropework, navigation, safety drills, use of docks, marinas, dinghies, tenders, shore-based briefings, liveaboard routines, and related activities before, during, or after the course.

This waiver applies whether training takes place on Tarka of Orwell, another YMC-arranged vessel, a third-party vessel, or a client-owned vessel.

2. Assumption of risk

I understand and accept that sailing and boating involve inherent risks. These risks include, but are not limited to: slips, trips, falls, impact injuries, falling overboard, cold water immersion, cold shock, hypothermia, drowning, injury from ropes, sails, winches, booms, anchors, engines, docks, dinghies or other equipment, seasickness, fatigue, sun or cold exposure, collision, grounding, fire, flooding, equipment failure, changing weather, wind, waves, tides, currents, restricted visibility, delays in emergency assistance, damage to personal property, serious injury, permanent disability, or death.

I understand that these risks cannot be eliminated completely, even with careful instruction, safety equipment, safety briefings, and prudent seamanship.

I voluntarily choose to participate and accept all risks associated with my participation, including risks that are known or unknown, foreseeable or unforeseeable, and whether arising before, during, or after the activity.

3. Release of liability

In consideration of being permitted to participate in YMC activities, I, for myself and for my heirs, executors, administrators, personal representatives, successors, and assigns, agree to release, waive, and discharge, to the fullest extent permitted by law:

Patrik Lindr operating as Yacht Master Class, Yacht Master Class, any instructor, skipper, assistant, contractor, employee, volunteer, representative or agent of YMC, the registered, legal, beneficial, or insured owner of any vessel used for YMC activities, the operator, manager or insurer of any vessel used for YMC activities, any marina, dock, facility or premises used in connection with YMC activities, International Yacht Training Worldwide (IYT) where applicable, and each of their respective directors, officers, employees, contractors, agents, representatives, successors, assigns, heirs, executors, administrators and insurers

(collectively, the “Released Parties”) from any and all claims, demands, actions, losses, damages, costs, expenses, or liability arising out of or connected with my participation in YMC activities, including claims for personal injury, illness, death, property damage, economic loss, or other loss.

This release includes claims arising from the negligence of the Released Parties, including negligent instruction, supervision, rescue, first aid, vessel operation, equipment use, planning, decision-making, or premises conditions, except to the extent such release is not permitted by law.

Nothing in this waiver is intended to release liability for intentional misconduct or any liability that cannot legally be released.

4. Indemnity

I agree to indemnify and hold harmless the Released Parties from any claim, loss, damage, cost, expense, or liability, including reasonable legal costs, arising from my participation, my failure to follow instructions, my unsafe or negligent conduct, my non-disclosure or misrepresentation of relevant medical or experience information, or any damage or injury caused by my actions or omissions.

5. Medical fitness and safety instructions

I confirm that I am medically and physically fit to participate. I agree to tell YMC before training begins about any medical condition, injury, medication, allergy, mobility limitation, disability, anxiety, swimming limitation, dietary issue, or other matter that could affect my safety, my ability to participate, emergency response, or the safety of others.

I agree to follow all reasonable safety instructions given by the instructor or skipper in command, including instructions about lifejackets, movement around the vessel, alcohol or drug impairment, and whether training may continue.

I understand that failure to follow safety instructions may result in my participation being refused or ended.

6. First aid and emergency treatment

If I become injured, ill, or incapacitated, I authorize YMC, the instructor, skipper, crew, emergency services, or other appropriate persons to provide or arrange first aid, rescue, evacuation, or emergency medical treatment as reasonably necessary.

I release the Released Parties from claims arising from first aid, rescue, evacuation, or emergency assistance provided in good faith, except to the extent such release is not permitted by law.

7. Governing law

This waiver is governed by the laws of British Columbia and the laws of Canada applicable in British Columbia. If any part of this waiver is found to be invalid or unenforceable, the remaining parts continue to apply.

8. Acknowledgement and signature

I confirm that I have read and understood this Waiver, Release & Assumption of Risk. I understand that sailing and boating involve inherent risks. I understand that by signing this document I am giving up certain legal rights, including the right to sue in some circumstances. I am the parent or legal guardian of the participant named above. I have read and understood this waiver. I consent to the participant taking part in the activity and agree to this waiver on my own behalf and, to the extent permitted by law, on behalf of the participant. I also agree to indemnify and hold harmless the Released Parties from any claim brought by or on behalf of the participant arising from the participant’s involvement in the activity, except to the extent such indemnity is not permitted by law.
